Please read these Terms of Service (“Terms”) carefully before using the maarich.com website or engaging Maarich Design for any services. By accessing our website or entering into a service agreement with us, you confirm that you have read, understood, and agree to be bound by these Terms.
Maarich Design is a web design, development, and digital marketing studio founded and operated by Rohit Hedda, based in Pune, Maharashtra, India. We provide services including (but not limited to) WordPress development, Shopify development, ASP.NET/C# web applications, MERN/MEAN stack development, e-commerce development, branding, and digital marketing.
By visiting our website, submitting an enquiry, or engaging us for services, you agree to these Terms. If you do not agree to any part of these Terms, you must not use this website or engage our services. These Terms apply to all visitors, clients, and third-party users of our website and services.
3.1 Scope of Services
The services provided by Maarich Design are defined in individual project proposals, statements of work, or service agreements issued to each client. Services may include web design, web development, e-commerce setup, branding, digital marketing, website maintenance, and related professional services.
3.2 Service Modifications
We reserve the right to modify, suspend, or discontinue any service offering at any time. We will provide reasonable notice to existing clients where such changes affect active engagements.
4.1 Proposals & Agreements
All projects commence upon acceptance of a written proposal or service agreement. Verbal agreements, casual conversations, or email exchanges do not constitute a binding contract unless formalised in a written proposal accepted by both parties.
4.2 Scope Changes
Any changes to the agreed scope of work must be submitted in writing and may result in additional charges and/or revised timelines. We will provide a written change order for approval before proceeding with out-of-scope work.
4.3 Client Responsibilities
Clients are responsible for providing accurate project briefs, required content, brand assets, timely feedback, and access to required platforms and accounts. Delays caused by the client’s failure to meet these responsibilities may result in revised project timelines and are not the responsibility of Maarich Design.
4.4 Revision Rounds
Each service package includes a defined number of revision rounds. Additional revisions beyond the agreed scope will be quoted and billed separately at our standard hourly or day rate.
5.1 Payment Terms
Payment schedules are defined in each project proposal. Typical arrangements include a deposit (50% of project value) payable before work commences, with the remaining balance due upon project completion or at milestones defined in the proposal.
5.2 Late Payments
Invoices are due within the payment period stated on the invoice (typically 7–14 days). Late payments may result in suspension of work, withholding of deliverables, and/or a late payment fee of 2% per month on the outstanding balance.
5.3 Refunds
Deposits are non-refundable once work has commenced. Refunds for partially completed projects will be assessed on a case-by-case basis and are at the sole discretion of Maarich Design. We do not offer refunds for completed and delivered work.
5.4 Currency
Invoices are issued in Indian Rupees (INR) for domestic clients and in US Dollars (USD) for international clients, unless otherwise agreed in writing.
6.1 Client Ownership
Upon receipt of full payment, the client receives full ownership of all final deliverables — including design files, source code, and website content — as specified in the project proposal. Ownership does not transfer until all outstanding invoices are settled in full.
6.2 Third-Party Assets
Projects may incorporate third-party assets such as stock images, fonts, icon libraries, plugins, themes, and frameworks. Licensing for these assets is the client’s responsibility unless explicitly included in the project scope. Maarich Design will advise on required licences but cannot assume liability for licence breaches relating to assets sourced or directed by the client.
6.3 Portfolio Rights
Unless the client requests otherwise in writing, Maarich Design reserves the right to display completed work in our portfolio, website, social media, and marketing materials.
6.4 Maarich Design IP
All methodologies, internal tools, templates, frameworks, and know-how developed by Maarich Design remain our intellectual property. The client receives a licence to use the final deliverables; they do not acquire rights to our internal development methodologies.
Both parties agree to keep confidential any sensitive business information, trade secrets, pricing, client data, or proprietary information shared during the course of an engagement. This obligation survives the termination of any project or agreement. If required, a separate Non-Disclosure Agreement (NDA) can be executed upon request.

We do not warrant that websites or applications will be free from all bugs or errors. We provide a post-launch support period as specified in each project proposal during which we will address reported defects at no additional charge.
To the fullest extent permitted by applicable law:
10.1 Termination by Client
A client may terminate a project by providing written notice. In such cases, the client shall pay for all work completed up to the date of termination. The deposit is non-refundable. Completed deliverables at the point of termination will be transferred upon settlement of all outstanding amounts.
10.2 Termination by Maarich Design
We reserve the right to terminate any engagement if the client breaches these Terms (including non-payment), behaves abusively toward our team, or requests work that violates applicable laws. In such cases, payment for work completed to date remains due.

These Terms are governed by and construed in accordance with the laws of the Republic of India. Any disputes arising from these Terms or any project engagement shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to arbitration in Pune, Maharashtra, India under the Arbitration and Conciliation Act, 1996. International clients may negotiate jurisdiction terms separately in their project agreement.
We reserve the right to update these Terms of Service at any time. The revised Terms will be posted on our website with an updated effective date. Continued use of our website or services after any revisions constitutes acceptance of the updated Terms. For active client engagements, material changes to service terms will be communicated directly.
These Terms, together with any project proposal or service agreement between Maarich Design and a client, constitute the entire agreement between the parties and supersede all prior discussions, representations, and agreements relating to the subject matter.
